Terms and Conditions for Oh My Look

1. Introduction and Acceptance

Welcome to Oh My Look (the "App"). These Terms and Conditions (the "Terms") govern your use of the App, which uses artificial intelligence to provide virtual try-on experiences, outfit recommendations, and fashion-related services.

By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our App.

2. Eligibility

To use the App, you must:

• Be at least 13 years old.
• If you are between 13 and 18 years old, have obtained permission from a parent or legal guardian.
• Have the legal capacity to enter into a binding agreement.
• Not be prohibited from using the App under applicable laws.

By using the App, you represent and warrant that you meet all eligibility requirements.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information during registration.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activities under your account.

4. Description of Services

Oh My Look provides the following AI-powered services:

• Virtual Try-On: Generate images showing you wearing clothing items using AI technology.
• Video Generation: Create videos showcasing outfits and looks.
• Digital Wardrobe: Upload, organize, and manage your clothing items.
• Outfit Recommendations: Receive AI-generated outfit suggestions based on your preferences, wardrobe, and calendar.
• Look Generation: Create styled looks combining different clothing items.

5. AI-Generated Content Disclaimer

IMPORTANT: By using our AI-powered services, you acknowledge and agree that:

• No Guarantee of Accuracy: AI-generated images and videos are approximations. They may not accurately represent how clothing will look on you in real life.
• No Guarantee of Fit: Virtual try-on results do not guarantee actual fit, sizing, or comfort of clothing items.
• Variations Expected: Results may vary based on image quality, lighting, pose, and other factors. The same inputs may produce slightly different outputs.
• Not a Substitute for Trying On: AI-generated content is for visualization purposes only and should not be the sole basis for purchasing decisions.
• Potential Imperfections: AI technology may produce artifacts, distortions, or unrealistic representations in some cases.
• Continuous Improvement: Our AI models are continuously updated, which may affect the style or quality of generated content.

We make no warranties regarding the accuracy, reliability, or suitability of AI-generated content for any particular purpose.

6. License Grant from You

By uploading or creating content through the App (including photos of yourself and clothing items), you grant Oh My Look a non-exclusive, worldwide, royalty-free, sublicensable license to:

• Process with AI: Use your images with our AI systems and third-party AI providers to generate virtual try-on content, analyze clothing, and provide recommendations.
• Store and Deliver: Store your content on our servers and cloud infrastructure to provide the service.
• Quality Assurance: Review generated content to ensure quality, detect issues, and improve our AI models and services.
• Technical Operations: Create derivative works necessary for the operation of the service (e.g., thumbnails, optimized versions).

This license is limited to providing, improving, and promoting our services. You retain ownership of your original content. This license terminates when you delete your content or account, except as needed for backup, legal compliance, or ongoing improvement of AI models (in anonymized or aggregated form where possible).

7. Subscriptions and Credits

7.1 Subscription Plans

Oh My Look offers subscription plans that provide monthly credits for generating looks and videos. Subscriptions are available as monthly or annual billing options.

7.2 Credit System

• Credit Allocation: Each subscription plan includes a monthly allocation of credits.
• Credit Consumption: Different generation types consume different amounts of credits (e.g., standard looks, HD looks, standard videos, HD videos).
• Monthly Reset: Subscription credits reset monthly, regardless of whether you have a monthly or annual billing plan.
• Rollover Cap: Unused subscription credits may roll over, subject to a maximum cap defined by your plan.
• Credit Types: You may have subscription credits (from your plan), reward credits (from promotions), and purchased credits (from top-up packages). These are consumed in a specific order.

7.3 In-App Purchases

• Payment Processing: All payments are processed through Apple App Store (iOS) or Google Play Store (Android). By making a purchase, you also agree to the respective app store's terms.
• Pricing: Prices are displayed in the App and may vary by region. Prices are subject to change.
• Automatic Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: You can cancel your subscription through your device's app store settings. Cancellation takes effect at the end of the current billing period.
• No Refunds: Subscription fees and credit purchases are generally non-refundable, except as required by applicable law or app store policies.

7.4 Top-Up Packages

You may purchase additional credits through one-time top-up packages. Purchased credits do not expire while your account remains active.

7.5 Free Tier

A limited free tier may be available, subject to usage limits and feature restrictions as displayed in the App.

8. Acceptable Use and Content Guidelines

You agree to use the App only for lawful purposes. You must NOT:

• Use the App for any fraudulent, illegal, or unauthorized purpose.
• Upload content that infringes on others' intellectual property or privacy rights.
• Upload explicit, pornographic, or sexually suggestive content.
• Upload content depicting violence, abuse, or illegal activities.
• Upload images of others without their consent.
• Attempt to circumvent usage limits, security measures, or access controls.
• Use automated systems (bots, scrapers, etc.) to access the App.
• Interfere with or disrupt the App's functionality or infrastructure.
• Reverse engineer, decompile, or attempt to extract source code.
• Resell, redistribute, or commercially exploit the App or its content.
• Impersonate others or misrepresent your identity.

8.2 Content Standards

All uploaded content must:

• Be appropriate for a general audience.
• Feature you or be clothing/fashion items you have the right to upload.
• Not contain offensive, harmful, or misleading material.
• Comply with all applicable laws and regulations.

9. Content Moderation

We reserve the right to:

• Review Content: Monitor, review, and analyze user-uploaded content and AI-generated content for quality assurance, safety, and compliance with these Terms.
• Remove Content: Remove or disable access to any content that violates these Terms or applicable laws, without prior notice.
• Suspend or Terminate: Suspend or terminate accounts that violate these Terms or engage in prohibited activities.
• Report: Report illegal content or activities to appropriate authorities.

We are not obligated to monitor all content but reserve the right to do so.

10. Intellectual Property

10.1 Our Property

The App, including its design, features, content, trademarks, logos, and underlying technology, is owned by Oh My Look or licensed to us. You may not use our intellectual property for any commercial purpose without written permission.

10.2 Your Content

You retain ownership of the original photos and content you upload. However, you grant us the license described in Section 6 to provide our services.

10.3 AI-Generated Content

AI-generated looks and videos are created for your personal use within the App. You may save and share generated content for personal, non-commercial purposes. Commercial use of AI-generated content requires our prior written consent.

11. Account Termination and Deletion

11.1 Termination by You

You may delete your account at any time through the App settings or by contacting us. Upon deletion:

• Your account and associated data will be scheduled for deletion.
• Active subscriptions should be cancelled through your app store before deletion to avoid further charges.
• We may retain certain data for up to 30 days to allow for account recovery or as required by law.
• Billing records may be retained for up to 7 years for legal and tax purposes.

11.2 Termination by Us

We may suspend or terminate your account immediately if you:

• Violate these Terms.
• Engage in fraudulent or illegal activities.
• Abuse or misuse the service.
• Interfere with other users or our systems.

We may also terminate or suspend services for any reason with reasonable notice.

11.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Unused credits and subscription time are generally not refundable except as required by applicable law.

12. Disclaimers and Limitation of Liability

12.1 "As-Is" Service

THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability and fitness for a particular purpose.
• Warranties that the App will be uninterrupted, error-free, or secure.
• Warranties regarding the accuracy or reliability of AI-generated content.
• Warranties that the App will meet your specific requirements.

12.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OH MY LOOK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages.
• Any loss of profits, data, or business opportunities.
• Any damages resulting from inaccuracies in AI-generated content.
• Any damages resulting from purchasing decisions based on our recommendations.
• Any interruptions or technical issues affecting service availability.
• Any unauthorized access to or alteration of your data.

Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Oh My Look, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property or privacy rights.
• Content you upload or create through the App.

14. Changes to Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Effective Date" at the top of these Terms.
• We will notify you through the App or via email for significant changes.
• Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

If you do not agree to the updated Terms, you should stop using the App and delete your account.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Delaware. You consent to the jurisdiction of such courts.

16. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oh My Look regarding the App.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.
• No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
